Terms of Service

Accounts must be created by an adult (18 or older) who is a parent, guardian, or caregiver with the parent's permission. Children may use Totstikes under your supervision through the child profiles you create. You're responsible for activity on your account and for keeping your password safe.

Totstikes is organised in levels (for example Daycare and Junior Kindergarten). Each level has its own 30-day free month with all of that level's games unlocked. The Daycare free month starts when your account is created; other levels' free months start the first time you open that level. No card is needed to start. After a level's free month, a selection of its games stays free forever, and the rest need that level's Premium.

• Premium is sold per level: each level costs $2.99 CAD per month (plus any applicable taxes) and unlocks only that level's games. For example, Daycare Premium does not unlock JK.
• Each level's subscription is billed automatically every month until you cancel it.
• If you subscribe during a level's free month, you keep your remaining free days; your first charge for that level happens when its free month ends.
• Payments are processed securely by Stripe. We never see or store your full card number.
• If we ever change the price, we'll tell you in advance, and the new price only applies from your next billing period. You can cancel before then.

You can cancel any level anytime from the Premium page (Manage subscriptions) in Totstikes, or by emailing contact@totstikes.com. When you cancel, you keep Premium until the end of the period you've already paid for, and you won't be charged again. Cancelling during your free month means you're never charged.

Because every family gets a free month to try Totstikes first, payments are generally not refundable, including for partly used months.

Charged by mistake? For example, you forgot to cancel before your free month ended. Email contact@totstikes.com within 7 days of the charge and we'll refund it. Nothing in these terms limits any refund rights you have under consumer protection law.

Please don't:

• copy, resell, or redistribute the games, pictures, sounds or other content;
• try to break, hack, overload, or get around the Premium lock or security; or
• use Totstikes for anything unlawful.

We may suspend accounts that break these rules.

Totstikes, including its games, characters, artwork, sounds and code, belongs to KingsMakers. We give you a personal, non-transferable permission to use it for your family's learning while your account is active.

How we collect and protect information is explained in our Privacy Policy.

We're always adding and improving games, so features and content may change. If we ever stop offering Totstikes, we'll give you notice and won't charge you for time you can't use.

Totstikes is a fun learning helper, not a replacement for teachers or parents. We work hard to keep it running well, but it's provided "as is", and we can't promise it will always be available or error-free. To the extent the law allows, our total responsibility to you for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms removes rights you have under consumer protection laws that can't be waived.

You can stop using Totstikes and ask us to delete your account at any time by emailing contact@totstikes.com.

If we update these terms, we'll change the date at the top, and tell you in the app or by email about important changes. Continuing to use Totstikes after a change means you accept the updated terms.

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there.
